Welcome to Trip ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Trip web application, widgets, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Trip is an AI-powered trip planning platform that helps users create personalized travel itineraries. The Service combines artificial intelligence with mapping, routing, places, and weather data from third-party providers to generate travel recommendations and visualizations. Trip does not store any user data, personal information, or trip plans on our servers. All data is processed in real-time and stored locally in your browser only.

2. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. User Accounts and Security

While the Service may be accessible without an account, certain features may require registration. You are responsible for:

  • Maintaining the confidentiality of any account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that your account information is accurate and current

5. Acceptable Use Policy

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by PlanTrip and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

6.2 Your Content

You retain all rights to any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service.

7. Third-Party Services and Content

The Service integrates with and relies upon third-party services, including but not limited to:

  • Google Maps Platform (Maps, Places, Routes APIs)
  • Google Gemini AI
  • Weather data providers
  • Other mapping and location services

These third-party services are governed by their own terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services. Any data provided by third-party services may be incomplete, inaccurate, or outdated.

8. User Responsibilities for Travel

You acknowledge and agree that:

  • The Service provides suggestions and recommendations only; all travel decisions are your sole responsibility
  • You must verify all critical information (including but not limited to hours of operation, safety conditions, travel restrictions, visa requirements, and health advisories) before traveling
  • You are responsible for complying with all applicable laws, regulations, and customs requirements of your destination
  • Travel involves inherent risks, and you assume all risks associated with your travel plans
  • We do not guarantee the accuracy, completeness, or timeliness of any travel information provided

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will function uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service or servers are free of viruses or harmful components
  • The results obtained from using the Service will be accurate or reliable
  • Any third-party content or services will be available or accurate

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLANTRIP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any travel-related incidents, accidents, or losses

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless PlanTrip and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your use of the Service

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to Terms

We may revise these Terms from time to time at our sole discretion. The most current version will always be posted on this page with the "Last Updated" date. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PlanTrip operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlanTrip regarding the Service and supersede all prior agreements and understandings, whether written or oral.

19. API Usage and Rate Limits

The Service relies on third-party APIs that may have usage limits and quotas. We reserve the right to implement rate limiting or usage restrictions to ensure fair access for all users and to comply with third-party service requirements. Excessive or abusive use may result in temporary or permanent suspension of access.

20. Export Controls

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country.
